1.0    SUMMARY


Santai Spa offers a number of leisure and wellness facilities to its customers from its Spa premises at Resorts World Birmingham, NEC. The Spa’s facilities include a fully equipped gym (the “Gym”) swimming pool with hot stone loungers and hydro jets) and various spa treatments (the “Leisure Facilities”).


When you become a Santai Spa Leisure member you are offered favourable rates on those facilities in exchange for your longer term commitment to pay us either an upfront or monthly membership fee for them.

·       one spa treatment per month (3 x 55 minute treatments or 6 x 25 minute treatments; or 3 x dry flotation experiences;

·       two personal training experiences per month;

·       Preferential Rates on further Santai Personal Training Sessions (£25 per hour, 6 sessions @ £125, 12 sessions @ £225)


2.2    All Members (and their guests) must be 18 years of age or older


2.3    All Yearly Plan members (above) will also receive:-


    2.3.1    a joining pack and water bottle,

    2.3.2    basic instruction from our team on the proper use of our Gym equipment;

    2.3.3    Access to fresh towels;

    2.3.4    Complimentary parking (provided ticket validated at Santai desk)

    2.3.5    10% off direct room bookings with the Genting Hotel;

    2.3.6    20% off midweek and 10% off weekend spa treatments (provided discount not used in conjunction with any other direct / third party offer);

    2.3.7    A Resorts World VIP Loyalty Card, enabling you to access a range of resort discounts from time to time (subject to participating merchant terms of redemption and use).


2.4    All payments to us will be made in advance by direct debit or standing order. Upfront yearly payments can be made in person or by phone.


2.5    If you wish to upgrade your yearly plan to a more comprehensive package please speak to us on 0121 273 1050 or Note that any yearly plan will run for a full year from any permitted switchover (subject to 3.2 below).




3.1    You may terminate your membership with Us:-


    3.1.1      Where You are on a yearly plan with us paid monthly, you can terminate your membership from the start of the eleventh month of your plan in person at our Spa or by emailing Us (  (using cancellation and your membership details in the subject header) or calling us on 0121 273 1050 . Termination issued will take effect at the end of the month following that in which notice is given. You agree to pay any membership fees due until such time as the notice you give takes effect;


    3.1.2      Where You are on a yearly plan with us that has been pre-paid in full, your subscription will automatically terminate at the end of the pre-paid period unless you renew your membership with us;


    3.1.3      Where we have seriously breached the contract between us and we have not rectified such breach within 14 days of notification from you to do so;


    3.1.4      Where/if we close our facilities for good, the agreement will terminate automatically from the relevant closing date;


    3.1.5   Should you complete your membership application online via our website, You may terminate the agreement within 14 days of application submission by notice to us (by email, post or in person) within the 14 days following submission of membership. Should you do so we agree to refund any fees paid. You agree, however, that this right ceases to exist if and when you use our facilities within the first 14 days following submission of your application to join us;


    3.1.6      Where the circumstances outlined in 3.2 apply and you also are on a yearly plan with us you may also terminate as set out in that clause;


3.2   You can cancel your membership with us at any time, if your circumstances change to such an extent that we are satisfied that it is not possible for you to continue to use our facilities (for example, due to medical reasons, redundancy, or if you move to a location more than 10 miles distant from our facilities (or 5 miles or more absent use of car / viable transport). To cancel your membership for medical reasons you will need to give us notice (in person, by phone (on 0121 273 1050) or email at and provide sufficient proof of your change in circumstances by the end of the month in which you notify us in order to cancel your membership at the end of that month. To cancel for non-medical reasons you must give us one full calendar months notice of your intention to do so as well as reasonable proof of your change in circumstances (again, in person, by phone or email) sufficient for us to reasonably verify that a change in your circumstances has in fact occurred. Provided that we are reasonably satisfied that there has been a verifiable change in circumstances, we will permit termination of our agreement (i) at the end of the month in which it is notified (for medical reasons) or (ii) within 30 days of the relevant notification from you (non-medical change in circumstances justifying termination). Where we accept termination on these grounds (only) we will arrange repayment to you of any un-utilised part of the membership fees you have either pre-paid / paid in full.


3.3    We may terminate the agreement between us:-


    3.3.1      where You breach the terms of the agreement between us, and do not rectify that breach within 14 days of our notice to you to do so;


    3.3.2      where You do not pay us when payment is due (for example, under a direct debit within 30 days of payment due date) and do not put us in funds within 14 days of our notice to you to do so. If any payment is due on or after the due date for payment we may engage a collections agency to pursue you for that debt and you will be responsible for all costs of enforcement which flow from any past due payment;


    3.3.3      without notice and with immediate effect:-

    where You commit a serious breach of the Code of Conduct displayed within our premises;

    where we reasonably consider that you have breached the Code of Conduct in another way, including but not limited to, violence, harassment, threatening or potentially criminal behaviour, towards our staff or other members;

    where we reasonably consider that you have repeatedly breached our Code of Conduct in a manner which we consider reasonably demonstrates your intention not to be bound by it or observe its requirements;

    where we reasonably consider that you have acted in a manner likely to cause nuisance or annoyance to our other members;


3.4    In the event of termination of membership under 3.4 (above) you will be liable to pay us reasonable compensation in respect of monies which are owing to us at the time of termination in accordance with the contractual arrangement between us set out here . Alternatively if you have pre-paid your membership in full (or monthly) you agree that we may retain a proportion of any sums paid to cover any reasonable costs or losses arising from your breach / our termination.




4.1     You must be at least 16 years of age or older to apply for membership with Us / use our Gym equipment.


4.2    By applying for membership with us, you are taken to confirm that the details that You have provided to us are true, accurate and up-to-date and that it is your sole responsibility to keep us updated to any relevant changes in the details supplied (including address, contact or banking details).


4.3    You agree to keep any relevant access codes, cards, or entry keys we may give you secret and secure and not to share them with any other third parties.


4.4    You agree and confirm that you are in good physical condition and capable of engaging in active or passive exercise and are not otherwise subject to medical advice suggesting that you cannot or should not do so.


4.5    You acknowledge that our staff are not medical professionals nor are they medically qualified, thus if you have any doubts about, or reasons to suspect, your medical fitness at all, you confirm that you will / have sought medical advice prior to joining us (and will, as and if needed) do so during your membership.


4.6    You agree and confirm that you will abide by the terms of our Code of Conduct.


4.7    You agree and confirm that personal trainers at our facilities are self-employed. Consequently we will not be liable nor responsible for any monies paid to a personal trainer unless they are administered by us as a contingent part of your applicable (yearly) membership plan.


4.8    We will not be liable to you, nor responsible for any loss, theft or damage to any property which you bring onto our facilities which is not locked away in a locker. The maximum compensation we will pay for any loss, damage, theft of property is limited to £250 in any and all instances even if the loss is caused by us or our team.


4.9    From time to time we may close some or all of our Facilities for refurbishment, cleaning, re-decoration, or other purposes. If we do so we will try and keep you informed of any likely disruption or temporary closure of our facilities but will not (absent serious and continued disruption to a significant part of the Facilities offered to you as part of your membership) be obliged to offer any full or part refund on the membership concerned.


5.0    GUESTS


5.1     All guests must be signed in by members.


5.2     All guests must themselves be 18 years of age or over.


5.3     A member can bring a maximum of 2 guests at any time. 


5.4     The member signing in guests is and remains responsible for their conduct on premises.


5.5    We reserve the right to refuse entry to members’ guests in the event of any actual or suspected abuse of these privileges occurs and including but not limited to  guests whom we consider should ultimately opt for a membership with us in their own right.


6.0    PRIVACY


6.1    When you join us, we will have to hold certain personal details about you to administer your membership, process your payment(s) and to administer any renewals. We will hold and process those details for the purposes of performing our contractual obligations towards you under the terms of membership.


6.2    For the safety and security of you and our staff and visitors and for purposes including the prevention and detection of crime, we operate 24 hour CCTV security at our premises.


6.3    All personal details will be held and processed in accordance with our privacy policy, available here




7.1     You agree that you shall:-


    7.1.1    use the card or fob we provide you with upon confirmation of your membership and not permit others to use same;


    7.1.2    attend your induction with us;


    7.1.3    show due regard and consideration for other members, visitors to, and staff of, our premises;


    7.1.4    not use abusive or foul language on premises;


    7.1.5    not use our facilities whilst intoxicated, impaired by, or under the influence of, drink or drugs (whether prescription or illegal);


    7.1.6    not behave in an anti-social or abusive manner towards other members or our visitors or staff;


    7.1.7     not damage any of our equipment and agree that you will be responsible to us to make full recompense for any such damage you or your guests may cause;


    7.1.8    not engage in inappropriate or threatening behaviour, or sexual activity on premises;


    7.1.9    carry a sweat towel to wipe down Gym equipment after use;


    7.1.10    not take bags onto the Gym floor;


    7.1.11    not make or receive phone calls on the Gym floor;


    7.1.12    not take photographs or videos on premises or post remarks or imagery onto the internet which might identify other members;


    7.1.13    replace equipment back into racks after use;


    7.1.14    not drop or throw weights down on the floor;


    7.1.15    use a locker to store your belongings whilst exercising with us;


    7.1.16    wear suitable clothing and footwear when exercising;


    7.1.17    not engage in any exercise activity that may be harmful (for example contact sports, boxercise) unless part of a structured and specific session managed by our team;


    7.1.18    not conduct any personal training business with other members;


    7.1.19    use any parking facilities at Resorts World in accordance with the parking terms of use;


    7.1.20    not engage in any criminal activity whilst on our premises;


    7.1.21    not cause damage on our premises or to any other persons property or personal effects;


    7.1.22    not eat on the Gym floor or in the pool area


8.0    GENERAL


8.1    References to “We” “Our” and “Us” in this document are to Genting Solihull Limited (T/A “Santai Spa”) a company registered in England (Company Number 06601106) whose registered office is situate at Genting Club Star City, Watson Road, Birmingham, B7 5SA. 8.2    We may assign the benefit of this agreement to a third party on notice to you. Should we do so, then Your rights under this agreement will not be prejudiced.


8.3    We will not be liable to you nor responsible for any failure to perform our obligations under this Agreement which are caused by any events which are outside or our reasonable control


8.4    Nothing within these terms affects your statutory rights.


8.5    The Agreement between us will be governed by English law and any disputes in relation to it will be subject to the exclusive jurisdiction of the courts of England.

  • This Guarantee is offered by all banks and building societies that take part in the Direct Debit Scheme. The efficiency and security of the Scheme is monitored and protected by your bank or building society.
  • If the amounts to be paid or the payment dates change, Genting Solihull Limited will notify you 10 working days in advance of your account being debited or as otherwise agreed.
  • If an error is made by Genting Solihull Limited or your bank or building society, you are guaranteed a full and immediate refund from your branch for the amount paid.
  • You can cancel a Direct Debit at any time by writing to your bank or building society. Please also send a copy of your letter to Genting Solihull Limited.
